Terms of Service

Last updated October 19, 2026

These terms are the agreement between your fire department, the people who use PassDown, and FirePassdown LLC(“PassDown,” “we,” “us”). They cover the PassDown app and website. By creating an account, or by ticking “I’ve read the Terms of Service, Privacy Policy and Security Summary,” you agree to them, along with our Privacy Policy and Security Summary.

1. Who’s who

  • Department means the fire department, district or agency that has a PassDown account. Admin means a person the department makes a department admin. You means the department and each person who uses PassDown through it.
  • The person who sets up a department confirms they’re allowed to accept these terms for it.
  • Each person who signs in also agrees to these terms for their own use.

2. What PassDown is for

PassDown is for passing information from one shift to the next: rigs out of service, equipment and station problems, alerts like a closed road or a hydrant out, handdowns, chores and similar station business.

It is not a dispatch, alerting or records system. Don’t rely on it as the only way to learn about anything that affects life safety. Notifications can arrive late or not at all (phones, signal and settings all play a part). Your department’s dispatch, policies and chain of command always come first, and PassDown doesn’t replace your official reports or records.

3. What not to put in PassDown

  • Patient information. No patient names, birthdates, addresses tied to a medical call, conditions, treatments, photos that show a patient, or patient care report details. Use the run or incident number instead. The Security Summary explains HIPAA and similar laws.
  • Members’ medical or sensitive personal details, like injuries, illnesses, reasons for leave, Social Security numbers, or bank and card numbers.
  • Criminal justice information from law enforcement systems, like criminal history.
  • Anything illegal, threatening, harassing or discriminatory, or anything you don’t have the right to share.

If something like this gets posted, delete it (or ask an admin to) as soon as you notice. Departments are responsible for what their members post.

4. Accounts

  • Use your own account and don’t share it. Keep your password and your phone locked.
  • Use your real name and an email address you can get to.
  • Admins decide who is in the department and what role each person has, and should remove people who leave.
  • If you think an account was misused, tell your admin and email us right away at support@firepassdown.com.

5. Your department’s information

  • Your department owns what it puts in PassDown (“department content”). We don’t claim it.
  • You give us permission to store, copy, process and show department content only to run PassDown for you, keep it secure, fix problems you report to us, and follow the law.
  • We don’t sell department content or personal information, we don’t use it for advertising, and we don’t use it to train artificial intelligence.
  • If your department is a public agency, its PassDown records may be public records. Your department handles public records requests and its records retention schedule. If we receive a request for your records, we’ll send it to you unless the law doesn’t allow us to.

6. Using PassDown fairly

Don’t use PassDown to break the law, and don’t:

  • try to get into accounts or information that aren’t yours;
  • test or probe its security without our written OK (report problems instead; see the Security Summary);
  • overload or disrupt it, or use automated tools to pull information out of it;
  • copy, resell or reverse-engineer it, except where the law allows; or use it to build a competing product.

7. Free trial, plans and paying

  • New departments get a 30-day free trial, with no card needed. After the trial, a plan is needed to keep using PassDown. The free Volunteer plan is for single-station volunteer departments.
  • Prices are on our website and are based on how many stations you have. Pay monthly or yearly by card or bank account (through Stripe), or by invoice (net 30, with a purchase order if you need one). Sales tax is added where it applies.
  • We’ll give admins at least 30 days’ notice before a price goes up. A new price starts with your next billing period.
  • You can cancel anytime, and PassDown keeps working until the end of the period you’ve paid for. We don’t refund partial periods unless the law requires it.
  • If an invoice is more than 30 days late, we’ll contact your admins before we limit the account.

8. Public agencies

If your department is a government agency:

  • Nothing here asks you to go against laws that apply to you, like public records, open meetings or purchasing laws.
  • If your agency needs a signed agreement on its own terms, ask us. A signed agreement controls wherever it differs from these terms.
  • If money for PassDown isn’t appropriated for a new fiscal year, you can cancel at the end of the period already paid for, without penalty.
  • Promises in section 12 to defend or reimburse us apply only as far as the law allows your agency to make them.

9. Changes to PassDown and to these terms

  • We improve PassDown often and may change or remove features. If we remove something your department relies on, we’ll tell your admins ahead of time.
  • If we change these terms, the Privacy Policy or the Security Summary in a way that matters, we’ll update the date, tell your admins, and ask everyone to agree again the next time they open PassDown.

10. Ending an account

  • Your department can stop using PassDown anytime. Admins can remove members anytime.
  • We can suspend or close an account that breaks these terms, puts others at risk or doesn’t pay. We’ll give your admins notice first, unless it’s an emergency like an active security threat.
  • After an account closes, your admins have 30 days to ask us for a copy of the department’s records, which we’ll send in a common format such as CSV. We then delete department content within 90 days. Copies in backups are deleted on their normal schedule, and we keep records the law requires (like invoices).

11. No guarantees

We work hard to keep PassDown running, accurate and secure, but it’s provided “as is” and “as available.” To the extent the law allows, we don’t promise it will always be available or free of errors, and we disclaim implied warranties, including merchantability, fitness for a particular purpose and non-infringement.

12. Limits on liability

  • To the extent the law allows, neither side is liable to the other for indirect, special or consequential damages, lost profits or lost data, even if told they could happen.
  • To the extent the law allows, our total liability for all claims about PassDown is limited to what your department paid us in the 12 months before the claim, or $100 if it paid nothing.
  • Departments will defend and reimburse us for claims caused by their content or by their members breaking these terms, as far as the law allows them to.
  • Nothing here limits liability that the law doesn’t allow to be limited, like liability for fraud.

13. The law that applies

Nevada law governs these terms, and disputes go to the state or federal courts in Nevada, unless your department is a public agency whose laws require its own state’s law or courts. Then those apply.

14. The rest

  • These terms, the Privacy Policy, the Security Summary and any signed agreement are the whole agreement about PassDown.
  • If part of these terms can’t be enforced, the rest still applies. Not enforcing something right away doesn’t mean giving it up.
  • We may transfer these terms if PassDown is sold or merged, and we’ll tell your admins.
  • Neither side is responsible for delays caused by things outside its reasonable control, like natural disasters or power and internet outages.
